Option 1 - Access to Billing and Medical Records.
During the term of this Agreement and for a period of three years thereafter, Hospital shall ensure that [Payer] its employees and/or representatives shall have, upon written request and 5 days advance notice, access during regular  business hours to all of Hospital's billing and medical records relating to this Agreement.  [Payer] may request copies of any of these documents at its own expense, at Hospital's standard copying rate normally charged to third parties.   In addition, Hospital shall make medical records available to appropriate state and federal authorities involved in assessing the quality of care or investigating the grievances or complaints of Covered Persons.  This Section shall survive termination of this Agreement, regardless of the reason for termination.

Option 2 - Access to Provider's Records
a.Plan’s Access.  Upon 10 business days’ prior written notice to Provider, Plan shall have the right to inspect or receive copies of the medical, administrative, and accounting records maintained by Provider pertaining to the billing of and rendering of Covered Services to Members, subject to confidentiality and other limitations of state and federal law, including, but not limited to, Provider’s policies and procedures governing access to records.
b.Time of Inspections.  Plan shall conduct inspections pursuant to Paragraph a above only at a mutually convenient time during Provider’s normal business hours.
c.Releases.  Plan shall be responsible for obtaining written releases by Members authorizing the release of medical information by Provider and shall indemnify and hold Provider harmless for any liability in connection with the requested release.
d. Reimbursement.  Plan agrees to reimburse all reasonable copy and shipping charges, including labor costs, Provider incurs to furnish the information the Plan requests pursuant to the terms herein.
